1. Acceptance of Terms

By creating an account, accessing, or using NogginLogger ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all of these terms, do not use the Service. Your continued use of the Service constitutes ongoing acceptance of these Terms.

2. Description of Service

NogginLogger is a voice-based personal logging application that uses artificial intelligence to transcribe and structure voice recordings and typed entries into health, wellness, and life data. The Service includes a mobile app (Android), web dashboard, and associated APIs.

3. Health and Medical Disclaimer

The Service provides AI-generated estimates for nutritional information (calories, macronutrients, ingredients), exercise metrics, and other health-related data. These estimates:

• Are approximations generated by artificial intelligence and may be inaccurate, incomplete, or incorrect
• Should not be relied upon for medical, dietary, or health decisions
• Are not verified by nutritionists, doctors, or any licensed health professional
• May not account for individual health conditions, allergies, medications, or dietary restrictions

Always consult a qualified healthcare professional before making decisions about your diet, exercise, medication, or health based on any data displayed in the Service. You assume all risk associated with using the Service's data to inform personal health decisions.

4. AI Accuracy Disclaimer

NogginLogger uses third-party artificial intelligence services (OpenAI Whisper for transcription, Anthropic Claude for data parsing and insights) to process your recordings and entries. You acknowledge that:

• AI-generated transcriptions may contain errors, especially with accents, background noise, or specialized terminology
• AI-generated calorie counts, macro estimates, and structured data are approximations, not verified facts
• AI-generated insights and journal summaries are automated observations, not professional advice
• You are responsible for reviewing and correcting AI-generated data when accuracy is important to you
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content

5. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials, including any API keys. You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have parental or guardian consent to use the Service.

6. Subscription and Billing

• NogginLogger offers Free, Basic, and Pro plans, as well as promotional pricing from time to time. Current pricing is displayed on the Membership page.
• Paid subscriptions are billed through Stripe. You may cancel at any time through the Membership page.
• Cancellations take effect at the end of the current billing period. No partial refunds are provided.
• We reserve the right to change pricing with 30 days notice to existing subscribers. Price changes do not apply to the current billing period.
• If payment fails, your account may be downgraded to the Free tier after a reasonable grace period.

7. Acceptable Use

You may not use the Service to:

• Store or transmit illegal, harmful, threatening, or abusive content
• Abuse, overload, or interfere with the Service's infrastructure
• Attempt to access other users' data or accounts
• Reverse engineer, decompile, or disassemble the application or APIs
• Use automated tools to scrape, crawl, or extract data from the Service beyond normal API usage
• Resell, sublicense, or redistribute the Service without written permission

8. Your Data

You retain ownership of all data you submit to the Service. We do not sell or share your data with third parties for marketing purposes. See our Privacy Policy for complete details on how your data is collected, processed, stored, and your rights regarding your data.

9. AI Processing and Third-Party Services

Voice recordings and text entries are processed by third-party AI services:

• OpenAI (Whisper API) for voice transcription — OpenAI Privacy Policy
• Anthropic (Claude API) for data parsing, insights, and journal generation — Anthropic Privacy Policy
• Auth0 for authentication — Auth0 Privacy Policy
• Stripe for payment processing — Stripe Privacy Policy

We send only the minimum data necessary for each service to function. These services have their own terms and privacy policies that apply to their processing of your data.

10. Audio Retention

Audio recordings are automatically deleted from our servers within 24 hours of successful processing. The transcribed text and structured data are retained in your account until you delete them or close your account.

11. Service Availability

We strive to maintain reliable availability but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

12. Account Termination

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently. You may delete your account at any time from the Profile page. Account deletion is permanent and removes all associated data, including entries, recordings, tags, and configuration. This action cannot be undone.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data (including AI-generated content) will be accurate or reliable.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOGGINLOGGER, ITS OPERATORS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR HEALTH-RELATED DAMAGES ARISING FROM:

• Your use of or inability to use the Service
• Any inaccuracies in AI-generated content, including calorie estimates, nutritional data, or health-related information
• Decisions you make based on data provided by the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct on or related to the Service

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless NogginLogger, its operators, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any health or medical decisions you make based on data provided by the Service.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Kansas.

17. Dispute Resolution

Before filing any legal claim, you agree to first attempt to resolve the dispute informally by contacting us at support@rebeltech.pro. If the dispute is not resolved within 30 days, either party may proceed with formal legal action as provided in Section 16. You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any class action or representative proceeding.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via the dashboard or email with at least 14 days notice before taking effect. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree with updated Terms, you must discontinue use of the Service.
